What is this Settlement about?
A $6,000,000 settlement with Expand Energy Corporation (formerly Southwestern Energy Company, Triad Hunter, LLC; SWN Production (Ohio), LLC, and SWN Production Company, LLC) and its subsidiary Expand Appalachia, LLC (collectively, the “Expand Defendants”) concerns post-production cost deductions from qualifying West Virginia oil and gas royalty payments.
Do I need to do anything right now?
No action is required at this time to remain in the Settlement Class. If you do not request exclusion by the applicable deadline, you will remain in the class.
Do I have to submit a Claim Form to receive money?
Yes. If the Court grants final approval, a Claim Form and Benefit Notice will be mailed or may be requested. You must timely return a valid Claim Form to receive a Settlement Payment. Remaining in the class alone does not guarantee payment.
How much could I receive?
Payments will vary. Your allocated share is based in part on your qualifying deductions compared with the qualifying deductions attributed to the class as a whole. The final amount also depends on participation and other provisions of the Settlement Agreement. Court-approved fees, expenses, and other applicable amounts are deducted from the fund before distribution.
When is the Fairness Hearing?
The Final Fairness Hearing is scheduled for March 11, 2027 at 2:00 p.m. The Court will determine whether the proposed Settlement should receive final approval. You may appear yourself or through your own attorney, but attendance is not required. A Notice of Intention to Appear must be submitted by its applicable deadline if you wish to appear.
